These Terms of Service ("Terms") govern your access to and use of the FitNFresh website located at fitnfresh.in, including any orders placed through the website. By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our website.

1. About FitNFresh

FitNFresh is a direct-to-consumer (D2C) brand selling health and fitness nutritional supplements under a single brand. We operate exclusively online through this website. Our products include protein supplements, amino acids, vitamins, and related health products. All products are manufactured, quality-tested, and dispatched by us from India.

2. Eligibility & Account Responsibilities

• You must be at least 18 years of age to create an account or place an order.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You agree to provide accurate, current, and complete information when creating an account or placing an order. Orders placed with false or inaccurate information may be cancelled.
• You must promptly notify us at support@fitnfresh.in if you suspect unauthorised use of your account.

3. Products & Availability

• All product descriptions, ingredient lists, and nutritional information are provided for informational purposes. Our products are nutritional supplements and are not intended to diagnose, treat, cure, or prevent any disease. Consult a qualified healthcare professional before use if you have a medical condition.
• Product availability is managed in real time. We reserve the right to limit quantities or discontinue products at any time without notice.
• Product images are representative. Slight variations in packaging or colour may occur.
• We reserve the right to limit order quantities per customer to prevent stockout or misuse.

4. Pricing, GST & Multi-Currency Display

• All prices for Indian customers are listed in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST). A detailed GST breakdown is available at checkout and on invoices.
• International prices displayed in USD, GBP, or CAD are static indicative prices set by us. They are not live exchange-rate conversions. Prices may not reflect real-time currency fluctuations.
• We reserve the right to correct pricing errors at any time. If an order is placed at an incorrect price, we will notify you and give you the option to confirm the order at the correct price or cancel it for a full refund.
• Coupon codes are subject to their specific terms and expiry dates. We reserve the right to revoke coupon offers at any time.

5. Placing Orders

a. Domestic Orders (India)

Indian customers can place orders using Cash on Delivery (COD) or online payment via Razorpay (credit/debit cards, UPI, net banking, wallets). COD orders are confirmed immediately upon placement. Online payment orders are confirmed once payment is successfully verified server-side through Razorpay's signature mechanism.

b. International Orders

International orders (outside India) are processed through our Order Request System. Submitting an international order request does not constitute a confirmed order. Our team will review the request, confirm availability, provide a final shipping quote, and contact you via email to arrange payment (wire transfer, PayPal, or other agreed methods). The order is confirmed only after admin approval and payment receipt.

c. Order Acceptance

We reserve the right to refuse or cancel any order at our discretion, including but not limited to cases of suspected fraud, product unavailability, pricing errors, or unserviceable delivery locations. You will be notified and any payment will be refunded in full.

6. Payment Terms

• Online Payments: Processed through Razorpay. Payment is charged at the time of order. Orders will not be dispatched until payment is confirmed via server-side verification.
• Cash on Delivery: Available for serviceable PIN codes within India. A COD fee may apply. Payment is collected by the courier at the time of delivery. Repeated refusal of COD deliveries may result in account restrictions.
• Failed Payments: If an online payment fails, no order is created and no amount is charged. If a charge occurs without an order being confirmed, please contact us immediately for resolution.

7. Shipping & Delivery

• Orders are dispatched within 2–5 business days of confirmation, subject to product availability and logistic partner availability.
• Estimated delivery time within India is 4–10 business days from dispatch, depending on your location. Remote areas may take longer.
• Tracking information is provided via email once your order is dispatched.
• Free shipping is available on orders above ₹999. Orders below this threshold attract a flat shipping charge.
• For international orders, shipping charges are quoted separately at the time of order confirmation. Import duties, customs fees, or local taxes applicable in the destination country are the sole responsibility of the customer.
• We are not liable for delivery delays caused by logistic partners, weather events, customs procedures, or circumstances beyond our control.

8. Order Cancellations

You may request a cancellation from your account under My Orders before your order is dispatched. Cancellations are subject to admin review and approval. Once an order has been dispatched, it cannot be cancelled — you must initiate a return after delivery. 9. Intellectual Property

All content on this website — including the FitNFresh brand name, logo, product names, product images, descriptions, and website design — is the exclusive property of FitNFresh and is protected under applicable intellectual property laws. You may not reproduce, distribute, republish, or commercially exploit any content from this website without our prior written consent.

10. Disclaimer & Limitation of Liability

This website and its content are provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by applicable law:

• We do not warrant that the website will be uninterrupted, error-free, or free of viruses.
• Our liability for any claim arising from use of this website or purchase of our products is limited to the amount paid for the specific product giving rise to the claim.
• We are not liable for any indirect, incidental, or consequential damages arising from your use of this website or our products.

11. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of our website shall be subject to the exclusive jurisdiction of the courts of Maharashtra, India. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force.
